Spousal Maintenance

New York State law allows either spouse to seek maintenance from the other during the marriage under certain circumstances, while a divorce or separation case is proceeding, or after the conclusion of a divorce or separation case.

There are many factors taken into consideration when determining eligibility. Included among these factors are the amount of time the parties have been married, the ability of each party to earn a living, the history of the relationship, the health and fitness of each spouse, and the education and career backgrounds of the parties.
